Age limit rule for SPED students

I am trying to find information regarding the “can’t be the oldest student in the school” rule, related to special education students. A parent asked me how it will effect her child who was retained once and has a January birthday. Thanks for any information offered.

As far as I know, the only age limit is that services may be extended until a student is twenty-one under certain circumstances. There is no other age cap in the law related to retention.
