Foreign language waiver in NYS??

Does anyone here know if its possible to get a foreign language requirement waiver in New York? ANd if so, what would allow that to happen?

I’m reviewing my son’s first IEP. He is pretty darn dyslexic, but because he is decoding at grade level they would not classify him as LD. They classified him as “other health” because he also has anxiety. But I’m wondering if I’m giving up the opportunity to get him out of this requirement if I accept this classification. i’m quite certain he cannot learn to speak or read another language!

When we lived in Buffalo, a colleague of mine’s daughter was having a horrid time with spanish. She even took it in summer school (repeat) and still couldn’t pass. She had been classified with an IEP in elementary school but had been declassified by middle school. I remember that my friend had to take in all her old records and then they let her take some substitute classes.

So I know it can be done, although I don’t know how the fact that your son doesn’t and never has had an IEP would impact things. And I don’t know how easy it is to do without the kind of experience I described.

thanks. Before I sign off on his IEP I want to be sure I’m not missing an opportunity to make my case about this. It could come back to haunt him if we mainstream him to our public HS.

I think since I have time I’m going to keep asking questions and consider his IEP a work in progress for now. Its not like they are providing us with any services or anything!
