Can anyone tell me

Submitted by an LD OnLine user on

the purpose behind NOT telling the school district the reasons for wanting an IEE when you submit the request? I know it used to be required. When did that change and how (where it is cited in the IDEA)? I have to submit another IEE request and want to be cler on how I am going to do it, Thanks!!!

I don’t know if it was changed. Seems like it’s always been cited in IDEA.
You are free to tell them why, but.
I believe the reason for allowing the parent the right to not give a reason,is simply not putting the burden on the parent to have a full understanding of what exactly the school didn’t test, what the tests mean etc.
It gives the parent the right to say, hey,I don’t know all about these fancy scores here, but I know my kid and this is not my kid.

The other reason to not go into details with the school, from an advocacy stand point,is: delaying your request. Getting into a long drawn out debate about the whys and where fors and giving them fuel for a due process fire.

It’s simple, you either give me an IEE,or prove your eval was adequate. If you give them reasons, you give them a reason to dispute you, rather than just going ahead and getting the eval.
