Can school give out info

Submitted by an LD OnLine user on

I have a question that I hope someone can help me with.

Can a school give out my son’s IEP information to staff members who do not have direct contact with him? In other words, should a teacher who does not have my son in his/her class be able to know this information?

I believe they cannot, but need to find out for sure and if I am correct, where to find this information in writing.

Thank you in advance for your help.

Hi Catherine and Welcome here!
While I’m talking from the Australian teacher situation, it is important to be able to share a students IEP information with other teachers.
As this is major way that teachers work out the best way to work with a student. Through discussion with their fellow teachers.
Where I would be more concerned with teachers, that didn’t ask for other teachers thoughts?

It depends on the country, appearantly. In the US, there is something called FERPA (Family Educational Rights and Privacy Act, 1974). It protects the rights of parents by limiting disclosure without concent. The parents can inspect the recorts, but you have the right to require the school to get your permission in writing beofe they give out any personally identifiable info from educational records.

I would assume this means you can request that they not release the information to any teacher who is not either teaching your child or involved in some sort of support role for your child.

I think you can find this information under FERPA and also under IDEA. Google the terms and it should take you to the laws. A bit of searching should bring you to the information you want.
