Does anyone have experience (direct or indirect) in filing a complaint with Dept. of Educ./Office of Civil Rights for a potential ADA violation? I am considering taking this step with my son’s college and filing a complaint on his behalf. My son has used all formal steps within the college to resolve the issue and still has not had satisfactory resolution to the problem. Essentially, he was given an inaccurate grade in a math class that the professor admitted was based on my son’s disclosure of his learning disability. (The situation is quite involved, but trust me when I say he did not receive “equal treatment” or “access” in the class.)
I know from past professional experience that filing a complaint with any federal agency is time consuming and a test of patience. However, I feel strongly that the college has acted in a discrminatory manner with my son and I struggle with not taking the issue to the next level.
Any guidance, feedback or thougts would be appreciated. I am going to post this on the post-secondary forum, but wanted to also reach a larger audience for feedback. After so many years of special education services in a wonderful public school system, I couldn’t have imagined the challenge that this has presented my son. I guess the struggle continues, just in a new setting.
