I just had my sons IEP meeting and had prepared written documentation of what outside evaluators recommended. The school had me sign the form as attendance when we arrived. They took notes and put in some items but a lot was left out because the person writing the IEP did not put in the information.
I was under the impression that I would be able to sign the IEP at the end of the meeting agreeing or disagreeing to what was in the IEP but they just handed me what was written from the notetaker as the IEP and it was the end of the meeting.
I had a letter from a medical personnel stating that he needed summer school to prevent regression and the only thing that they school could say is that they have no program for him.
I tape recorded the meeting.
What should I do to get the items that I had written up attached to his IEP?
Should I call another meeting?

The staff at the school stated that since he has done so well that he needs no summer program. The district stated that it would have to be a 6 week period of time that the child would need in the fall to get back to their previous level of education to qualify for a summer program. They feel that he does not qualify. They stated that the letter from a medical personnel that evaluated him and states that he needs a summer program does not make it that they need to provide a program and that they are following the law.

Okay here is the section of IDEA that you need. If you have a professional suggesting he needs ESY to prevent regression,YOU and this professional are part of the IEP team,you are part of the decision. The issue of not having anywhere for him is not what IDEA says either. I would write a regiastered letter,include this section of IDEA and request another discussion of whether they are complying with the law.. At the meeting really focus in on having them show documented data of how “well” he has done. If they can’t reasonably show you major progress,they can’t deny he will not regress without ESY.
§300.309 Extended school year services.
(a) General.
(1) Each public agency shall ensure that extended school year services are available as necessary to provide FAPE, consistent with paragraph (a)(2) of this section.
(2) Extended school year services must be provided only if a child’s IEP team determines, on an individual basis, in accordance with §§300.340-300.350, that the services are necessary for the provision of FAPE to the child.
(3) In implementing the requirements of this section, a public agency may not—
(i) Limit extended school year services to particular categories of disability; or
(ii) Unilaterally limit the type, amount, or duration of those services.
(b) Definition. As used in this section, the term extended school year services means special education and related services that—
(1) Are provided to a child with a disability—
(i) Beyond the normal school year of the public agency;
(ii) In accordance with the child’s IEP; and
(iii) At no cost to the parents of the child; and
(2) Meet the standards of the SEA.

Is it work doing all of this when you know that they will say he doesn’t qualify since he has made progress. He has made progress because we have 2 days of tutoring a week and we review with him everyday the Wilson program.
I also don’t know what to do with this. The school does not want to provide any feedback to me on a weekly basis so I can inform the tutor of what he is doing in school. Last year the LD teacher took a couple of seconds to check what she did and sent it home on a weekly basis.
The administration only wants my child to write in his asssignment notebook what he needs to do for the Wilson program. They don’t want the LD teacher to write anything. It is like they think it is fun to waste my money. I am only trying to utilize the tutor to the best of her ability and they don’t want any regualr communication.
What should I do. I think they are hiding something, why would a district not want a parent to help there child and reinforce what they learn in school so they can get out of the LD program quicker?

I would suggest you get this into the IEP,if it is, they a not complying with the law,and you could file a State Complaint. I know it’s hard and they want you to give up. Don’t… Good Luck,we are all here to help.

Hmm,they admitted not having a summer placement for him? Did they disagree to the placement? Did they have you sign this incomplete IEP? This I suppose would be considred a draft IEP,I would request the completed one,before signing anything. I would send a certified letter,explaining to them that if they do not have a summer placement,they are obligated to find one. They will probably schedule another meeting,and deny that he needs it. Yes,you need another meeting.
