My son moved last year to his Dad’s. He is now in 5th grade and dyslexic. We had a bigger district here and he was under 504 and all kinds of training and modifications in place. He is now in a tiny, tiny school in Oklahoma. He likes the attention since the classes are so small but he’s failing. I’m trying to get this all worked out. 504 is a Federal Law, right? Even this tiny school should be able to make modifications, right? I’m going up there next week to talk to the teacher with his Dad and am trying to get my ducks in a row. Any suggestions would be greatly appreciated.

I agree with Janis. Our son is dx’d LD, but because he wasn’t actually failing, he was placed on a 504 Plan. However, all testing results and subsequent 504’s have plainly stated that should he begin failing, restesting and an IEP - Special Ed. has not been ruled completely out.
Does your son’t new school have copies of the 504 and testing results which placed him on a 504 to begin with? You will want to have copies of those with you. You or dad should send a written letter requesting a formal review of the 504 (Yes, it’s Federal). At that meeting, you can then discuss what has been modified/accommodated to date and if a full evaluation needs to take place at that time. A written documentation requesting a formal review is very important. Documentation is what drives our system unfortunately.

If he is dyslexic and failing, he needs to be referred for special education services, not a 504. He needs remediation for his reading skills. Accommodations are improtant but cannot substitute for having appropriate instruction. I suggest your husband request an evaluation in writing.
