My son (9th grade) failed a New York State Regents exam needed for graduation and so he is taking the course over in summer school and trying the exam again in August. His IEP requires a consulting special ed teacher to be in the classroom during the school year for that subject, but he is on his own in the summer. Is a school district required to follow the IEP in the summer, or would that have to be an amendment?

I had the same issue myself this summer. My daughter has a IEP in place and had a spec ed teacher in her class most of the year. Her teacher was not notified about my daughters needs and knew nothing about her strenghths or weaknesses. Boy was I un- impressed. I was told to conntact the Director of the summer school and complain to her. I have learned to never assume anything. Was summer school any help? We will see.
