How do you know if a 3rd gr student that is above average in all areas
but can only spell verbally, but can’t spell in a written form is devlopmentally delayed or had a learning disability? He writes at about a beginning first grade level.

This sounds like dysgraphia.
I would ask for an occupational therapy evaluation. A lot of dysgraphia is not responsive to OT, but I would think that an OT eval would be the first step in getting a diagnosis.
