FCAT and retainment

Have 9 yr old twins,they took the State Test called the FCAT one passed and the other failed. The one that failed has a LD. He can read but cannot comprehend what he reads unless someone can read it with him. Since he failed the test and attended the summer reading camp the school gave and failed the SAT-9 test they gave, they are retaining him. His grades during school are all A, B, and of couse Reading as C & D. I would like to know if they can do this with a child that has a LD and if I can fight this and get him promoted to 4th grade. Also, if he is qualified for the “No Child Left Behind Act” (we do not qualify under low income)but does he qualify for it with an IEP and a LD. I’m a parent new to all of this IEP stuff and Need advice.

In my district, we would never retain a student with a recognized disability that is making mainly “A”s and “B”s because they didn’t pass a mandated test. I don’t know what the guidelines are in your district, but it sounds like he’s being punished. I would check with your school district or ask your child’s case manager about promotion criteria.
