I am trying to find information regarding the “can’t be the oldest student in the school” rule, related to special education students. A parent asked me how it will effect her child who was retained once and has a January birthday. Thanks for any information offered.

I have never heard of this. the only reference to age that I know of in the law is the one which allows the IEP team, under carefully described circumstances, to allow a student to receive services until they are twenty-one. Other than that, I was not aware of any age cap.
