included student loses aide time

I have an included student, who will be placed in a 2nd grade classroom next year without any aide time ( this year he had a full time aide). He is cognitively about a 3-yr old and we have had many behavior issues. The district expects me to take him for 3 hrs a day and have him in the classroom the rest of the time without any support and other special needs children in the same class ( LD)…..they say because my numbers are low at the moment….. What to do? No wonder on classroom teacher wants to have an included student……and this child is very hyperactive- touches everything, constant motion,etc. so it also affects kids pulled to get instruction in the Resource room….. it has aide time on his IEP or 6+ hrs …
HELP !

Sounds like you’ll be sacrificing teaching for safety — concerns for legal liability are an angle that sometimes works when you’ve got a kiddo who really needs constant monitoring. I’d get my sincere concerns in writing pretty far up the chain of command — and also concern about *your* responsibility to meet his IEP needs since if it’s in his IEP and they aren’t doing it, they’re violating the law… and you don’t want to be included in the “they.”
How does the parent feel about this? If they’ve got down there that the kid needs an aide, and there isn’t one, then gosh, the school should be paying for placement in a setting where there *is* an aide.

What does the parent think about the child being without an aide? You are part of the upcoming IEP. Your input is necessary. Was he full inclusion last year and if so did he have an aide? Numbers in the classroom have nothing to do with the placement of an aide. The IDEA mandates that the child should be placed in the least restrictive enviornment with additional assistance and modifications. This would be the aide. If the parent indicated that they do not want an aide then I would document his disruptions and need for an aide. Then approach the parent with your concerns. They should then call for an IEP to request for an aide.

Also the child sounds like he has sensory integration dysfunction. I would suggest they assess the child for this problem. All the symptoms you listed are an indicating factor: unable to sit still, touching everything and everyone…

If it says in his IEP he is to have a full time aide ,he should have one. The school district is violating the law if they do not have one. I , as a parent would write to the state that they are in violation .

I don’t understand what is or 6+ hrs? Is that resource room help? Are they trying to take away the aide or just haven’t provided it? In Michigan, that child can be placed in the resource room full day if that is what the IEP team recommends. Is there an LRE aide? I think there needs to be at least five students on the building case load.

I would talk with your administration or union rep and let them understand that this against the law and you don’t want to be a part of it.
