making up missed work while at sped

My son’s reg. ed. teacher keeps trying to assign him work that he missed while in sped. or OT. Is there law against such a thing? Isn’t this the equivalent to extending his school day?

It’s not against the law. (Basically, anything teachers assign isn’t against the law.) Assuming you’ve discussed the matter with the teacher and explored other ways to keep him current with the class, you could meet and include the stipulation in his IEP that the teachers make arrangements so that he does not have added homework because of time missed. (Lots depends on what grade, of course, and what happens if he *doesn’t* do what was done in class.) The IEP *is* a legal document.

It probably depends on what he is missing. My son goes to resource room for language arts at the same time as the rest of the class does language arts. His regular teacher does not grade him in this area. If he were to miss something else, I am sure he would have to make it up. Perhaps you could have the timing of sp. ed changed so that he doesn’t miss anything that he ultimately is responsible for.
