We have a 504 plan, it is not being implemented very much I might add. Initially we were told by the physchologist in writing the child need and IEP and to meet with the speech/lang path. The child has Central Auditory Processing. The school denied the IEP because grades were too good. After doing some research, we are finding out that grades DO NOT MATTER in making a determining factor. Well we got the nice consolation prize of the 504; something was better than nothing….but since it is not being implemented we actually received nothing. The way the child qualified for the 504 was the major life activity that it affected was learning.
I feel we need to have them also put on the 504 major life activity of hearing. The child hears well but does not process all the time fully. After doing research I found where CAPD is classified as a hearing imparement such as a hearing loss.
I need some help where to go from here. I would like to find some way that the CAPD can fall under IDEA. I was told it could possibly fall there but the advocate never got back with us. Is the only thing the child is covered under is the ADA law?
We are going to request the school do a full scale evaluation on the child also, sending the letter certified and return receipt.
Any help/suggestions to help us prepare for our meeting? Thanks

CAPD is NOT classified as a hearing impairment or hearing loss. See the post from me under the IDEA post directly below this one, as CAPD relates to the IDEA.
My son has CAPD, inattentive ADHD, and NLD. He gets all As and Bs in the general ed classroom. However, he has a large point discrepancy between achievement and ability, so (according to the school system) he qualifies for special education services under the IDEA.
According to the IDEA, no single criterion shall be used to determine special education services, but getting the schools to recognize that without going to mediation or legal hearings (due process) is extremely difficult. Has your child been formally tested to determine any point discrepancies between ability and achievement? What strengths and weaknesses do you see in your child? Do you think any significant discrepancies might show up if you had your child tested?
