Florida Vouchers Ruled Unconstitutional...Does It Include Mc

Submitted by an LD OnLine user on

I’ve just heard the news that a Florida Circuit Judge has ruled that the Voucher system is unconstitutional (FL state constitution). Because the McKay is semi-attached to the A+ Plan, does this mean that McKay Scholarships are also unconstitutional? I’ve tried several sites and can’t get a specific answer. Let me just say “Ack! 5000 extra dollars!”

The dept of ed purposely changed the name of the McKay to Scholarship for this purpose.

I was interested in this also, and have someone looking into it,I will let you know what I find out.

The last time this issue went to court,I read the court transcripts. The one thing the judge stated was he would not address the voucher for the disabled student, which is what is was called back then. His reasoning was it is not uncommon for a disabled student to be enrolled in a private school by the public school, for the purpose of specialized education.
So I believe we are safe for now. I also was told that the voucher would be banned for the students this coming school year, but couldn’t be applied to students already using them from prior school years.

BREAKING NEWS: An August 5 ruling by a state judge is striking down the Opportunity Scholarships program. An appeal is likely, and additional maneuvers to keep the program running are likely. This ruling does not effect the two other statewide programs — FloridaChild Scholarships and McKay Scholarships.

hopefully this will help you sleep tonight tired:-)
