special ed teacher vs. aide

If my son’s IEP says he gets a certain amount of time per week with a special ed teacher (as an extra teacher in a regular classroom with a regular teacher), can the school district substitue a teacher’s aide for half of the time. I want to know if that is legal in New York State. Thank you!

I rather doubt it, if it’s spelled out specifically.

I would document this in a letter of concern, specifically addressing why and how this is having an impact (what’s the aide doing and why should it be done by a teacher?)

This is the norm. Exactly what does the IEP state? Our IEPs never state the special education teacher will be the room. They might state special education staff, special education services, or special education support. These can mean either myself or my aide. Any services provided by my aide are special education services and are provided under my direction and guidance.

Special education certification does not prepare a teacher to teach children academic skills and manage explosive, potentially dangerous behaviors. Teachers are not mental health professionals. There is too much of this going on.

I am a little confused by your answer. Where does the parent say anything about “explosive, potentially dangerous behaviors”? The question was about substituting an aide for a teacher. What am I missing here?
