Hi everyone. It has been a while since I posted but I really need some help, support, or whatever. I went to a 504 evaluation meeting this morning and the Director of Special Education denied our request for 504. Her reason is that he isn’t failing any subjectsa and that he tested above average. He does have ADHD and I have been fighting since November for accomodations. He has an SST plan, only GA uses this without 504, and is in early intervention classes for his weak subjects. I posted the report on ADDed Support@msn if anyone is interested. I need something to give soon!! he has tested well but his performance is average, meaning just passing, and I don’t get why they continue to deny my son protection. The director said that 504 is only accomodations and that he is recieving that thru SST, however I discovered that SST is not enforcable, If the teacher doesn’t want to do it she isn’t required to comply…this is why I demanded 504. We have an advocate and a specialist, niether of them thought that the school would/could deny. I am so lost with this!! I have read every law I can find and have researched other cases and have provided copies of these to the school as well during the battle and here we are at the end of the school year and still nowhere. Someone help!!
I would post on wrightslaw.com also. You’ll get some professional input. Good luck. It doesn’t sound possible. Terry
