Twin with Learning Disability

My 5 year old daughter, who has a twin brother, has a speech disability and also a disability related to motor skills. The principal at the elementary school has stated that it is there policy that all twins will be seperated beginning in 1st grade. My daughter becomes hysterical when separated from her brother. To me, this is not conducive to her learning. Can we use the “No Child Left Behind” act to fight the separation?

I don’t think “No Child Left Behind” would apply, but if your child has an IEP and medical professional or clinical psychologist professional opinion is that it is not in your child’s best interest for the twins to be separated, an IEP could override school policy. Have you asked for a functional behavioral assessment?
